Forward Pharma loses challenge to European patent covering dimethyl fumarate, Tecfidera royalties at risk, appeal planned; shares down 14%The European Patent Office hasrevoked Forward Pharma A/S's (FWP-13.8%) EP 2801355 patent ('355 patent) following challenges from several parties. The company says its is disappointed with the decision and plans to appeal.The '355 patent covers a PH-controlled release pharmaceutical composition for oral use that contains dimethyl fumarate (DMF), the active ingredient in Biogen's (BIIB-2.2%) MS drug Tecfidera. If the ruling holds, it will be a win for Biogen since it will delay the encroachment of generic competitors.In February 2017, Biogen paid Forward $1.25B to settle their dispute over a patent covering methods of treating MS with 480 mg of DMF.
