Moderna said the agreement “provides certainty going forward” across its infectious disease portfolio, including candidates such as mNEXSPIKE and mCOMBRIAX, with no future royalties owed. Under the settlement, Moderna will pay $950 million in the third quarter of 2026 and record the charge in the first quarter. The company will also appeal the District Court's Section 1498 ruling, arguing its government-contractor immunity limits liability. Moderna said no accrual has been booked for a potential additional payment of up to $1.3 billion because a loss “is not considered probable.” If the appeal ultimately succeeds at any stage, Arbutus and Genevant would refund any additional payment with interest.
