In a 5-0 decision, the Appellate Division of the state Supreme Court's Third Department ruled Wednesday that Charter Communications, whose services are branded as Spectrum, was ineligible for the tax break it received from 2012 to 2014 and must pay back $7.8 million in back taxes, plus interest. The ruling affirms a determination by the state Tax Appeals Tribunal. During an audit, the state Department of Taxation and Finance discovered that Charter received a tax break as a "qualified emerging technology company," despite not meeting the statutory requirements. The mass media company, which is headquartered in Stamford, Conn., had filed for the tax break as a "combined group" - a group of corporations required or permitted to file a single, aggregate New York state corporate franchise tax return.
