GettyWith the COVID-19 crisis proliferating export controls across the world, protecting our access global supply chains, while strengthening our own industrial base, has received renewed attention. The International Trade Commission (ITC) plays an important role in protecting America’s trade interests, particularly in fighting global IP theft, by blocking import of infringing goods.Unfortunately, creative complainants now are using the ITC’s authority under Section 337 (technically19 U.S.C. § 1337) as a parallel court system to litigate cases that federal courts should hear. This section was intended to prevent unfair importation—not spawn an IP regime parallel to that of the U.S. courts. Creating a parallel IP regime both distracts the ITC from its vital mission to fight unfair international competition and undermines intellectual protections for all.Global IP theft is a serious issue.
