Last month, Spirit Airlines announced it had received immediate access to $50 million—just half of a previously agreed-upon $100 million third funding round laid out in a Debtor-in-Possession (DIP) financing agreement. The remaining $50 million from bondholders will only come “if the company can show progression on the reorganization plan,” Nicole Langston, a bankruptcy scholar and assistant professor of law at Vanderbilt University Law School, told Forbes.
