The U.S. Court of Appeals for the D.C. Circuit in the 2-1 decision , opens new tab said that while the manager in 2022 specifically warned the worker not to give buttons to customers, her comments could have discouraged workers from distributing any union paraphernalia, even among themselves, upholding a National Labor Relations Board ruling. After the manager twice saw the barista give buttons to customers - one of whom worked at a different Starbucks store - she told the worker that she "couldn't be handing out things to customers ... while on work time," according to filings in the case, and that she should pass out buttons "outside of work." "The board's conclusion that [the manager's] statement was not limited to interactions with customers is supported by substantial evidence," the D.C. Circuit said in an unsigned opinion.
