This comes after oral arguments this afternoon in a matter where Cox Communications has been accused of helping infringers to download some of the most popular musical works of our time by allowing downloading and distribution of works over Internet sites of their subscribers. The legal issues were not necessarily whether enforcement could be done efficiently, but had to turn on how to decide if Cox was a “contributory” infringer. The Court's decision could revolve almost entirely around that issue. We probably would not be at this juncture if the job of an Internet company to economically monitor online activity were not all but impossible. The law sets various protocols to address online copyright infringement, and in most if not all the cases, accused infringing activities are by serial infringers and not by someone who just happens to download a single work.
