The company filed paperwork last week in U.S. Bankruptcy Court in Georgia, according to Restaurant Dive. The move comes after ARC closed the 77 restaurants in December 2025 following a dispute with the Hardee's company. The fast-food chain accused the franchisee of violating the terms of its franchisee agreement. ARC acquired the restaurants from the Summit Restaurant Group in 2023 as part of an auction of Summit's holdings. At the time Summit was navigating the Chapter 11 bankruptcy process. According to the Hardee's website, the locations owned by ARC are listed as temporarily closed. ARC owns Hardee's restaurants in Alabama, Florida, Georgia, Illinois, Kansas, Missouri, Montana, South Carolina and Wyoming. For now, it's unclear how the bankruptcy filing will impact the shuttered ARC locations.
